Terms & Conditions

Etudiant specializes in providing excellent education-related services to our tutors and clients (parents and students). Please take time to review the following terms and conditions to help us serve you better. By using the services by Etudiant, you agree to all the terms and conditions as stated.

 

Clients:

 

It is completely free to input the respective information to Find a Tutor. There is no additional/ hidden cost from registration to confirmation.

 

1. Tuition Venue

 

The students' place of residence will be the default venue for tuition unless otherwise agreed upon by the client, tutor, and Etudiant.

 

2. Tuition Rate

 

A fixed tuition rate will be agreed upon from the point of confirmation among the parties involved (Tutor, Client, Etudiant). If any of the involved parties wish to make amendments to the tuition rates, they must first obtain official approval from Etudiant.

 

3. Payment

 

All payment must be made to Etudiant. There shall not be any monetary affiliation between the clients and the tutors.

 

An invoice will be issued to you in advance via email. Payment of the monthly tuition fees must be made to Etudiant at least one week in advance before the commencement of the first lesson of the billing period.

The following forms of payment are accepted:

  • ATM transfer / Internet Banking to DBS Current Account 120-352939-3

  • PayNow to Etudiant's phone number at 97568453

The invoice will include a reference number. Kindly provide the reference number in the description (for transfer via PayNow) for our record purposes. Thereafter, Etudiant will send you an e-receipt to your email when the payment is received. 

 

Etudiant reserves the right to amend the rates at any time without notice.

 

Please inform Etudiant if the tutor brings up monetary issues with you.

 

4. Refund Policy

 

As payment is received in advance, Etudiant will provide returns in the event of a "no-show" tutor. If a tutor does not show up for lessons as planned, kindly contact us and we will provide a prorated refund for the number of lessons that were recognised as "no-show". Unless otherwise indicated, all other payments made to Etudiant are non-refundable.

 

5. Confirmation

 

A tuition confirmation email will be sent to you upon the confirmation of rate and assignment. Etudiant will not be liable for any issues that arise from any uninformed engagement between the client and tutor.

 

6. Tutor Profiles

 

Etudiant pursuit both precision and accuracy. However, Etudiant does not guarantee that all the description provided by the tutors are error-free.

It is your responsibility to check the credentials and certificates of the tutor on the first lesson to ensure that his/her credentials and qualifications are satisfactory.

7. Change of Tutor

 

There is no contract or obligation to complete a fixed number of lessons.

 

Nevertheless, if you wish to change your tutor, please inform Etudiant at least 1 week in advance. We will find you a suitable replacement at no additional charge.  

 

8. Termination of Lesson

 

Please inform Etudiant at least 1 month in advance for the termination of the lesson.

 

Under any termination circumstances, the client is required to pay the full tuition fee for the number of lessons conducted by the tutor. The remaining prorated amount will be refunded to the client. 

However, in the event that the client has provided false information either intentionally or unintentionally, Etudiant reserves the right to terminate the contract and impose a penalty fee of up to $100 on the client.

Tutors:

 

Tutors are to meet the following criteria and abide by the following terms and conditions:

 

1. Registration

 

Registering as a tutor with Etudiant is completely free. You must be a Singaporean, Permanent Resident or possess a valid employment pass. The minimum age required is 18 years old.

You, as a tutor, must ensure that you provide the most updated, honest, accurate and complete information about yourself. You will have to produce the necessary documents to certify your academic qualifications and eligibility status upon request. In the event of any tutor be caught with the act of dishonesty, Etudiant reserves the rights to impose a penalty fee* and blacklist such tutors from future applications.

 

You, as a tutor, will be solely responsible for all lesson contents, such as documents, graphics, messages and text that you upload, email, post or made available on the website of Etudiant. The certificates uploaded on the website will only be used for verification purposes by Etudiant and will not be made available to the clients or any third-party. Hence, you will have to bring your certifications and transcripts on the first day of the lesson for parents’ verification.

 

Etudiant retains the right to refuse your application and to delete, edit or cancel your content at any time should we deem necessary.

You are responsible for all required registrations with the Employees provident fund as a self-employed person as you are providing private tuition service under the contract of service to the client as an independent contractor.

 

Etudiant will not be liable for any loss or damage arising from your registration as a tutor or for any unforeseen circumstances that may arise from the assignment.

Upon submitting the registration form with your uploaded certificates, you will become a registered tutor with Etudiant.

 

By agreeing to our terms and conditions, you are granting us the permission to present your profile including, but not limited to your personal name, age, gender, past academic institutions attended, qualifications, time and availability for lessons, tuition rates, tutoring experience and profile picture to the respective clients.

 

2. Contacting for Assignments

 

You may receive calls, messages or emails of new assignments and of reminders for the first lesson. However, Etudiant cannot guarantee that you will receive notification from us as the selection process is dependent on both your profile and the client's preferences. Etudiant will contact you for further discussion if you are shortlisted. However, Etudiant is not under any obligation to contact you if you are not shortlisted. In addition, we do not guarantee that you will be selected for the assignment after you have responded to the notification.

 

3. First Lesson and Assignment

 

A tuition confirmation email will be sent to you for every new tuition assignment. The tutor must confirm acceptance of the assignment through email or messages even after the agreement has been made through the phone or other communication media. You, as a tutor, will have to reply to the confirmation email sent by Etudiant to confirm the acceptance of the assignment.  

 

Upon confirmation, you are expected to turn up for lesson punctually with the necessary documents and certificates for parents’ verification. In the case of no-show or when the tutor is unable to produce the necessary documents, Etudiant has the right to stop the tutor’s assignment, impose a penalty fee* on the tutor and remove the tutor from the database at any time.

 

The tutor will receive the student's address after the tutor has accepted the tuition assignment by replying to Etudiant through email.

 

The client can request to stop the tuition lessons at any time. In this case, you will receive payment for the number of lessons completed unless the client is dissatisfied with the lesson.

 

However, if the assignment is cancelled immediately by the client after the first lesson for any reason, you, the tutor will receive 50% of the fees for the first lesson that is completed. Etudiant will notify you again should there be another suitable student.

 

4. Makeup Lesson

 

You, as a tutor, are expected to provide weekly lessons on the stated day and time. If you are unable to make it for a particular lesson for any reason, you will have to arrange and provide a makeup class for the client. 

 

5. Payment & Commission

 

The tuition rate would have been fixed at the point of confirmation among the tutor, the client, and Etudiant. The tuition rate cannot be changed unless approved by Etudiant.

 

Etudiant charges a commission for the first month which is equivalent to 50% of the fees for the first month or 50% of the amount of the lessons given if the service is terminated before completion of the first month. In the subsequent months, you will get the full payment of the agreed sum between Etudiant and you.

 

Etudiant will receive the payment of the monthly tuition fees by the client for every month. Thereafter, Etudiant will make payment to the tutors at the end of each month or after 4 weeks of the lesson. Payment of the monthly tuition fees will be made to the tutor via PayNow or ATM Transfer/ Internet Banking. Thereafter, we will inform you of the crediting of your salary. 

 

There shall not be any monetary affiliation between the clients and the tutors. Tutors do not have the right to bring up monetary issues with the client.

 

Etudiant reserves the right to amend the rates at any time.

 

Clients will pay a nominal monthly administrative fee to Etudiant for services including but not exhaustive, billing, internet banking, and maintenance. This will not affect the payment that the tutor will receive.

 

If a trial lesson is necessary and is conducted by the tutor, 50% commission applies to each trial lesson.

 

6. Termination of Tuition

 

6.1. Termination of Tuition (By Client)

 

If the client cancels the assignment within the first month of the tuition, the tutor will receive 50% of the number of lessons completed. Etudiant will notify you again whenever there is another suitable student.

 

Under any termination circumstances, the client is required to pay the full tuition fee for the number of lessons conducted by the tutor.

 

6.2. Termination of Tuition (By Tutor)

 

You, as a tutor, must be committed to the tuition assignment for at least one month. Should you fail to do so, no tuition fee shall be paid and a termination fee of one-month tuition fee may be imposed on the tutor.

However, the tutor also has the right to terminate the lesson if any of the information provided by the client is found to be untrue. Upon gaining approval from Etudiant, we will provide a pro-rated payment of the lessons that were conducted to the tutor.

 

6.2.1. Termination After the Commencement of the First Lesson

 

If you, as a tutor, cancel the assignment within the first month of the tuition with a valid reason, you will receive a prorated commission of the number of lessons provided. The prorated commission will be determined on a case-by-case basis. Etudiant will notify you again should there be another suitable student.

 

If you, as a tutor, cancel the assignment within the first month of the tuition without a valid reason, the tutor will not receive any payment and the tutor will be removed from the database.

 

You, the tutor, will have to notify the clients and Etudiant at least 1 month in advance with regards to the termination of lessons. Failure to do so will result in the following being imposed on the tutor:

 

- A penalty fee of $100 and

- The retention of any prorated tuition fee that the tutor is supposed to receive. This fee will only be rendered to the tutor after the penalty fee of $100 has been paid.

 

6.2.2. Termination Before the Commencement of the First Lesson

Once the tuition assignment is confirmed (before the commencement of the first lesson), you, the tutor, cannot cause the cancellation of the assignment directly, indirectly or fail to show up. If that happens, you will be required to compensate $100 to Etudiant as administrative charges and you will be removed from the database.

 

7. Code of Conduct

 

Tutors must be responsible and be able to provide effective and pleasant tuition services to the students.

 

Penalties will be imposed on tutors who display poor conduct such as having the following issues:

 

Punctuality

 

For instance, the tutor is late for lesson frequently and leaves early before the lesson is completed. Etudiant has the right to stop the tutor’s assignment and remove the tutor from the database at any time.

 

'No-show'

 

For example, tutors who did not turn up for the lesson without informing the client through a phone call or in person. SMS or emails are not considered as a means for informing the client. The client would have to acknowledge the postpone of the lesson. In the case of ‘No-show’, the tutor will not receive their payment. Etudiant has the right to stop the tutor’s assignment and remove the tutor from the database at any time.

 

Professionalism

 

Tutors must give their full attention to giving tuition throughout the entire lesson. Complains lodged against a tutor causing distraction during lessons such as the use of mobile phones for personal entertainment will result in a severe warning from Etudiant. Etudiant has the right to stop the tutor’s assignment and remove the tutor from the database at any time.

 

Dress code

 

The client has the right to reject a tutor due to inappropriate dressing. Please dress appropriately at all times during the conducting of lessons.

 

Complaints

 

Etudiant takes all complaint seriously. Etudiant will be fair and unbiased towards both tutors and clients. All complaints lodged will be thoroughly investigated.  

 

 

Tutors & Clients:

 

Disclaimer

 

Etudiant will not act as an arbitrator or mediator should any conflicts or disagreements arise between the tutor and the client. However, we may be able to offer our suggestions and views when requested.

 

Indemnification

 

You agree that you shall defend, indemnify, save and hold Etudiant harmless from any and all demands with regards to liabilities, losses, costs, and claims, including reasonable attorneys' fees if asserted against Etudiant and its employees, that may arise or result from any of the service provided, performed, agreed to be performed, or any tuition-related services provided by Etudiant.

 

Etudiant will not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that you may utilize. You agree to bear full and exclusive responsibility arising from such risks and consequences of your usage of the services provided by Etudiant.

 

Etudiant may provide links to other Internet sites or resources. As we have no control over such sites and resources, you acknowledge and agree that we are not responsible for the availability of such external sites or resources. We do not endorse and will not be responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

 

You further acknowledge and agree that our company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such sites or resources.

 

By agreeing to the terms and conditions, it will be deemed that you give your consent to receiving phone calls, messages, and emails from Etudiant for the tuition-matching process.

 

Etudiant reserves the rights to amend the terms & condition without prior notice.
